Our Terms and Conditions

Scape Goats Limited and Fence & Deck Co. Wellington Limited will herein be referred to as the “Company”. The terms “we,” “us,” and “our” refer to the Company.

The work within the scope of the estimate/quote will herein be referred to as “the Work”.

The client, contact or their representative/s or affiliate/s will herein be referred to as the “Client”. “You” refers to the Client.


Acceptance of our estimate/quote creates a binding contract for the Work.

Although the Company takes care to prepare its estimates accurately, the estimate is not a quote and the price for the Work shall be the Company’s actual labour costs plus the cost of materials.

Upon acceptance of the estimate/quote (and prior to commencement of the job) the Company will request a 30%-50% deposit (determined by the Company based on the size and estimated duration of the job).

The Company may render invoice for work done as the Work progresses. Invoices will be emailed to the address provided by the Client. Payment is due within 7 days from the invoice date or as otherwise specified on the invoice.


Costs and quantities are estimated based on the information available at the time of quoting. Once the Work has commenced, requirements could change resulting in additional labour, materials and/or costs being incurred.

Variations to the scope of the Work may be required for example due to poor condition of foundations and framework once exposed, extra strengthening work required, extra site clearance required, additional waste disposal required, and/or any other works not already quoted for but requested by the Client or deemed as necessary for safety, strength, durability and/or to meet industry standards or best practices.

If the scope of the Work has to change due to unexpected circumstances the Company will discuss this with the Client before proceeding, including a rough estimate of the additional cost of the Work.


Subject to the above, the work description as agreed to in writing by the Client, reflects the final and agreed scope of the Work.

The Company reserves the right to refuse to vary the scope of the Work if it considers that the variation is unnecessary or disproportionate to the original scope of the Work agreed.

If, after commencement of the Work, the Client wishes to engage the Company for additional works, it may be considered as a new job, quoted for and scheduled separately to any works already in progress.


Industry best practices will be applied where appropriate. Otherwise, the Company’s employees will use their initiative, experience and industry knowledge to achieve an end result to a high standard.

All building and landscaping materials will be new and fit for purpose. The precise materials used will be at the discretion and judgement of the Company unless specified in the estimate/quote.


The Company’s builders are experienced Landscape Builders and not Licensed Building Practitioners (LBPs), therefore will not undertake ‘restricted building work’ (RBW). Restricted building work involves a building’s structure, weathertightness and design of fire safety systems, and includes, for example, a retaining wall over 1.5 metres in height.

If the scope of the Work estimated will or might involve restricted building work the Company will discuss this with the Client and may subcontract or engage a builder to undertake any restricted building work at additional cost.

Otherwise the Company will endeavor to work with any LBP contracted by the Client to undertake the restricted building work.

Unless expressly agreed, the Company will not be responsible for applying for or obtaining any building consents, code compliance certificates or any other documentation required under either the Building Act 2004 or the Resource Management Act 1991.

The Company will be photographing the Client’s site before, during and after the Work. These photographs may be used for internal company records, staff training, Company work portfolio and/or marketing purposes unless the Client objects in writing prior to commencement of the Works.

This Privacy Policy (“Privacy Policy”) is designed to help you understand what information we gather, how we use it, what we do to protect it, and to assist you in making informed decisions when using our Service.  Unless otherwise indicated below, this Privacy Policy applies to any website that references this Privacy Policy, any Company website, as well as any data the Company may collect across partnered and unaffiliated sites.

Personal Information:

In general, we do not sell, trade, rent or otherwise share your Personal Information with third parties without your consent. We may share your Personal Information with vendors and other third-party providers who are performing services for the Company. In general, the vendors and third-party providers used by us will only collect, use and disclose your information to the extent necessary to allow them to perform the services they provide for the Company.  For example, when you provide us with personal information to complete a transaction, verify your credit card, place an order, arrange for a delivery, or return a purchase, you consent to our collecting and using such personal information for that specific purpose, including by transmitting such information to our vendors (and their service providers) performing these services for the Company.

However, certain third-party service providers, such as payment processors, have their own privacy policies in respect of the information that we are required to provide to them in order to use their services.  For these third-party service providers, we recommend that you read their privacy policies so that you can understand the manner in which your Personal Information will be handled by such providers.

In addition, we may disclose your Personal Information if required to do so by law or if you violate our Terms of Use.

Non-Personal Information:

In general, we use Non-Personal Information to help us improve the Service and customize the user experience. We also aggregate Non-Personal Information in order to track trends and analyze use patterns of the Service. This Privacy Policy does not limit in any way our use or disclosure of Non-Personal Information and we reserve the right to use and disclose such Non-Personal Information to our partners, advertisers and other third parties at our sole discretion.


We implement reasonable precautions and follow industry best practices in order to protect your Personal Information and ensure that such Personal Information is not accessed, disclosed, altered or destroyed.  However, these measures do not guarantee that your information will not be accessed, disclosed, altered or destroyed by breach of such precautions. Our Service is hosted by Weebly, Inc. (“Weebly”).  Weebly provides us with the online e-commerce platform that allows us to provide the Service to you.  Your information, including Personal Information, may be stored through Weebly’s servers.  By using the Service, you consent to Weebly’s collection, disclosure, storage, and use of your Personal Information in accordance with Weebly’s privacy policy available at https://www.weebly.com/privacy.


As part of the Service, we may provide links to or compatibility with other websites or applications. However, we are not responsible for the privacy practices employed by those websites or the information or content they contain.
